Local Government Cyber Security

An act relating to local government cyber security;

creating s. 282.31855, F.S.; creating the Local
4
Government Cybersecurity Protection Program within the
5
Florida Digital Service, to be administered by the
6
Florida Digital Service; providing the purpose of the
7
grant program; requiring the Florida Digital Service
8
to enter into certain data-sharing agreements with
9
local governments for a specified purpose; requiring
10
the Florida Digital Service to administer the grant
11
program based on specified criteria to provide
12
information technology commodities and services to
13
local governments for a specified purpose; requiring
14
the Florida Digital Service to contract for
15
information technology commodities and services and
16
award such commodities and services to local
17
governments; establishing preference for certain
18
counties under the grant program; requiring grants to
19
be annually awarded by a certain date; authorizing
20
local governments to purchase information technology
21
commodities and services under specified criteria;
22
providing local governments are responsible for all
23
costs associated with such purchases; requiring the
24
Florida Digital Service to prepare and submit a
25
specified report to the Governor's Office of Policy
26
and Budget and the chairs of the legislative
27
appropriations committees; authorizing the Florida
28
Digital Service to apply for and accept certain funds
29
or grants; providing for future repeal unless saved by
30
the Legislature through reenactment; providing an
31
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Section 282.31855, Florida Statutes, is created
36
to read:

282.31855 Local Government Cybersecurity Protection
38
Program.—

(1) The Local Government Cybersecurity Protection Program
40
is created within the Florida Digital Service, to be
41
administered by the Florida Digital Service. The purpose of the
42
grant program is to assist eligible local governments in
43
mitigating and defending against cybersecurity threats,
44
including, but not limited to, ransomware incidents.
45
(2) Under the grant program, the Florida Digital Service
46
shall enter into data-sharing agreements with local governments
47
as necessary to facilitate the collection, analysis, and
48
exchange of security-related information to support the
49
detection, prevention, and response to cybersecurity incidents
50
consistent with s. 282.318.

(3)(a) The Florida Digital Service shall administer the
52
grant program based on objective eligibility and evaluation
53
criteria to provide information technology commodities and
54
services directly to local governments for the purpose of
55
developing and enhancing cybersecurity risk management programs
56
consistent with s. 282.3185.

(b) The Florida Digital Service shall contract for
58
information technology commodities and services and shall award
59
such commodities and services to local governments eligible
60
under the grant program criteria.

(c) In awarding information technology commodities and
62
services, the Florida Digital Service shall give preference to
63
fiscally constrained counties as described in s. 218.67(1).
64
(d) Grants shall be awarded to eligible local governments
65
by December 1 of each year.

(e) A local government may purchase information technology
67
commodities and services from the contracts managed by the
68
Florida Digital Service to administer this section even if it
69
does not apply for or receive a grant award. The local
70
government shall be solely responsible for all costs associated
71
with such purchases.

(f) Beginning December 15, 2027, and each year thereafter,
73
the Florida Digital Service shall prepare and submit to the
74
Governor's Office of Policy and Budget and the chairs of the
75
legislative appropriations committees a report on the
76
implementation and outcomes of the grant program for the
77
preceding fiscal year. The report must include:
78
1. The total number of grant applications received and
79
number and dollar amount of grants awarded, as well as the
80
number of applications denied, withdrawn, or deemed ineligible.

2. A list of the local governments awarded a grant,
82
identifying the cybersecurity commodities or services funded by
83
each grant and their purpose.

3. A description of federal and other funds received and
85
used in furtherance of the grant program.

(4) The Florida Digital Service may apply for and accept
87
any funds or grants made available to it by any agency or
88
department of the Federal Government to further the grant
89
program.

(5) This section shall stand repealed on July 1, 2031,
91
unless reviewed and saved from repeal through reenactment by the
92
Legislature.

Section 2. This act shall take effect July 1, 2026.
