Advanced Wastewater Treatment

A bill to be entitled

An act relating to advanced wastewater treatment;
3
providing legislative findings; requiring certain
4
sewage disposal facilities to submit specified reports
5
to the Department of Environmental Protection;
6
requiring the department, in consultation with water
7
management districts and sewage disposal facilities,
8
to submit specified reports to the Governor and
9
Legislature and to post such reports on its website;
10
providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. (1) The Legislature finds that the discharge
15
of inadequately treated wastewater and aging sewage disposal
16
facilities compromise the quality of the environment, including
17
freshwater, brackish water, and nearshore and offshore salt
18
waters, and threatens the quality of life and local economies in
19
the state that depend on those resources. The Legislature
20
further finds that requiring advanced wastewater treatment or
21
better at all sewage disposal facilities with a permitted
22
capacity of greater than 1 million gallons per day in this state
23
is a necessary long-term investment that will fundamentally
24
improve wastewater treatment.

(2) By July 1, 2027, and annually thereafter, sewage
26
disposal facilities with a permitted capacity of greater than 1
27
million gallons per day in this state must report to the
28
Department of Environmental Protection all of the following:
29
(a) Year of construction for the facility and any
30
maintenance or upgrades.
31
(b) Total permitted volume of water treated daily.
32
(c) Actual permitted volume of water treated daily,
33
including the most recent 1 year and 5 year averages.
34
(d) Current level of treatment, including concentrations
35
for each of the following:
36
1. Biochemical oxygen demand.
37
2. Suspended solids.
38
3. Total nitrogen.
39
4. Total phosphorus.
40
5. Perfluorooctanoic acid.
41
6. Perfluorooctanesulfonic acid.
42
7. Molybdenum.
43
8. Other contaminants of emerging concern as determined by
44
the department.

(e) Estimated total pollutant loading based on permitted
46
volume and concentrations.

(f) Disposal methods and the volume discharged to any
48
receiving waterbodies, if applicable, pursuant to s.
49
403.064(16), Florida Statutes.
50
(g) Total volume and concentration of any permitted and
51
nonpermitted wastewater spills since 2010.
52
(h) Elevation of the facility and supporting
53
infrastructure.
54
(i) Location within a floodplain, flood zone, or coastal
55
high-hazard area and, if applicable, the corresponding zone
56
number.

(3) In order to prioritize the upgrade of sewage disposal
58
facilities and investments in wastewater infrastructure, by
59
December 31, 2027, and annually thereafter, the Department of
60
Environmental Protection, in consultation with the water
61
management districts and sewage disposal facilities, shall
62
submit to the Governor, the President of the Senate, and the
63
Speaker of the House of Representatives a report detailing all
64
of the following for all sewage disposal facilities with a
65
permitted capacity of greater than 1 million gallons per day in
66
this state and post the annual report on its website:

(a) Year of construction for the facility and any
68
maintenance or upgrades.

(b) Total permitted volume of water treated daily.

(c) Actual permitted volume of water treated daily,
71
including the most recent 1 year and 5 year averages.

(d) Current level of treatment, including concentrations
73
for each of the following:
74
1. Biochemical oxygen demand.

2. Suspended solids.

3. Total nitrogen.

4. Total phosphorus.

5. Perfluorooctanoic acid.

6. Perfluorooctanesulfonic acid.

7. Molybdenum.

(e) Estimated total pollutant loading based on permitted

(f) Disposal methods and the volume discharged to any

receiving waterbodies, if applicable, pursuant to s.

403.064(16), Florida Statutes.

(g) Impairment status of any receiving waterbodies within
89
the watershed.
90
(h) Implementation status of total maximum daily loads and
91
basin management action plans and assigned reductions for load
92
allocations and wasteload allocations for pollutants of concern.
93
(i) Total volume and concentration of any permitted and
94
nonpermitted wastewater spills since 2010.
95
(j) Elevation of the facility and supporting
96
infrastructure.
97
(k) Location within a floodplain, flood zone, or coastal
98
high-hazard area and, if applicable, the corresponding zone
99
number.

Section 2. This act shall take effect July 1, 2026.
