2 An act relating to safety design standards for office
3 surgery suites; creating s. 553.884, F.S.; requiring
4 the Florida Building Commission and the State Fire
5 Marshal to establish safety design standards for
6 certain office surgical suites by a specified date;
7 defining the term "office surgery suite"; providing an
8 effective date.
10 Be It Enacted by the Legislature of the State of Florida:
12 Section 1. Section 553.884, Florida Statutes, is created
13 to read:
14 553.884 Office surgery suites; safety design standards.—
15 (1) By January 1, 2027, the commission must establish
16 within the Florida Building Code and the State Fire Marshal must
17 establish within the Florida Fire Prevention Code, safety design
18 standards that allow office surgery suites to provide the
19 following services or treatment simultaneously for up to six
20 patients on an outpatient basis:
21 (a) Treatment for patients that renders the patients
22 incapable of taking action for self-preservation under emergency
23 conditions without the assistance of others.
24 (b) Anesthesia that renders the patients incapable of
25 taking action for self-preservation under emergency conditions
26 without the assistance of others.
27 (c) Treatment for patients who, due to the nature of their
28 injury or illness, are incapable of taking action for self-
29 preservation under emergency conditions without the assistance
30 of others.
31 (2) Such standards must be an alternative to the safety
32 design standards for ambulatory health care occupancies. For
33 purposes of this section, an "office surgery suite" is that
34 portion of a physician's office where surgery is performed.
35 Section 2. This act shall take effect July 1, 2026.
