1 A bill to be entitled
2 An act relating to public records and meetings;
3 creating s. 461.0182, F.S.; providing an exemption
4 from public records requirements for certain
5 information held by the Department of Health or the
6 Board of Podiatric Medicine pursuant to the Interstate
7 Podiatric Medical Licensure Compact; authorizing the
8 disclosure of such information under certain
9 circumstances; providing an exemption from public
10 meetings requirements for certain meetings or portions
11 of certain meetings of the Interstate Podiatric
12 Medical Licensure Compact Commission or its executive
13 committee or other committees; providing an exemption
14 from public records requirements for recordings,
15 minutes, and records generated during the exempt
16 meetings or portions of such meetings; providing for
17 future legislative review and repeal of the
18 exemptions; providing statements of public necessity;
19 providing a contingent effective date.
21 Be It Enacted by the Legislature of the State of Florida:
23 Section 1. Section 461.0182, Florida Statutes, is created
24 to read:
25 461.0182 Interstate Podiatric Medical Licensure Compact;
26 public records and meetings exemptions.—
27 (1) A podiatric physician's personal identifying
28 information, other than the podiatric physician's name,
29 licensure status, licensure number, obtained from the
30 coordinated information system, as described in Article VIII of
31 s. 461.0181, and held by the department or the board is exempt
32 from s. 119.07(1) and s. 24(a), Art. I of the State Constitution
33 unless the state that originally reported the information to the
34 coordinated information system authorizes the disclosure of such
35 information by law. If disclosure is so authorized, such
36 information may be disclosed only to the extent authorized by
37 the law of the reporting state.
38 (2)(a) A meeting or a portion of a meeting of the
39 Interstate Podiatric Medical Licensure Compact Commission or the
40 executive committee or other committee of the commission,
41 established in Article XI of s. 461.0181, at which matters
42 specifically exempted from disclosure by federal or state law
43 are discussed is exempt from s. 286.011 and s. 24(b), Art. I of
44 the State Constitution.
45 (b) Recordings, minutes, and records generated during an
46 exempt meeting or portion of such a meeting are exempt from s.
47 119.07(1) and s. 24(a), Art. I of the State Constitution.
48 (3) This section is subject to the Open Government Sunset
49 Review Act in accordance with s. 119.15 and shall stand repealed
50 on October 2, 2031, unless reviewed and saved from repeal
51 through reenactment by the Legislature.
52 Section 2. (1) The Legislature finds that it is a public
53 necessity that a podiatric physician's personal identifying
54 information, other than the podiatric physicians name, licensure
55 status, or licensure number, obtained from the coordinated
56 information system, as described in Article VIII of s. 461.0181,
57 Florida Statutes, and held by the Department of Health or the
58 Board of Podiatric Medicine be made exempt from s. 119.07(1),
59 Florida Statutes, and s. 24(a), Article I of the State
60 Constitution. Protection of such information is required under
61 the Interstate Podiatric Medical Licensure Compact, which a
62 state must adopt in order to become a member state of the
63 compact. Without the public records exemption, this state will
64 be unable to effectively implement and administer the compact.
65 (2)(a) The Legislature finds that it is a public necessity
66 that any meeting of the Interstate Podiatric Medical Licensure
67 Compact Commission or the executive committee or other committee
68 of the commission held as provided in s. 461.0181, Florida
69 Statutes, in which matters specifically exempted from disclosure
70 by federal or state law are discussed be made exempt from s.
71 286.011, Florida Statutes, and s. 24(b), Article I of the State
72 Constitution.
73 (b) The Interstate Podiatric Medical Licensure Compact
74 requires the closure of any meeting, or any portion of a
75 meeting, of the Interstate Podiatric Medical Licensure Compact
76 Commission or the executive committee or other committee of the
77 commission if the presiding officer announces in a public
78 meeting that, in connection with the performance of the
79 commission's duties, the commission must discuss certain
80 sensitive and confidential subject matters. In the absence of a
81 public meetings exemption, this state would be prohibited from
82 becoming a member state of the compact.
83 (3) The Legislature also finds that it is a public
84 necessity that the recordings, minutes, and records generated
85 during a meeting held as provided in s. 491.022, Florida
86 Statutes, which is exempt from public meetings requirements be
87 made exempt from s. 119.07(1), Florida Statutes, and s. 24(a),
88 Article I of the State Constitution. Release of such information
89 would negate the public meetings exemption. As such, the
90 Legislature finds that the public records exemption is a public
91 necessity.
92 Section 3. This act shall take effect on the same date
93 that HB 1213 or similar legislation takes effect, if such
94 legislation is adopted in the same legislative session or an
95 extension thereof and becomes a law.
