An act relating to biosolids management; amending s.

403.0855, F.S.; prohibiting the Department of
4
Environmental Protection from issuing or renewing a
5
permit for certain biosolids land application sites if
6
there is a permitted wastewater treatment facility
7
that accepts septage for higher levels of treatment
8
and which meets specified requirements; providing an
9
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Subsection (6) of section 403.0855, Florida
14
Statutes, is redesignated as subsection (7), and a new
15
subsection (6) is added to that section, to read:

403.0855 Biosolids management.—
17
(6) The department may not issue or renew a permit for a
18
land application site which authorizes disposal or land
19
application of septage, as defined in s. 381.0065(2), as Class B
20
biosolids if there is a permitted wastewater treatment facility
21
that accepts septage for higher levels of treatment which is:
22
(a) Less than 30 miles from a proposed Class B biosolids
23
land application site;
24
(b) Owned or operated by the Federal Government or a
25
federal agency, a state government body or agency, or a
26
political subdivision of this state; and
27
(c) Not defunct, used for other purposes, or out of
28
capacity.

Section 2. This act shall take effect July 1, 2027.
