for working individuals with disabilities; providing a

short title; creating s. 409.9141, F.S.; requiring the

Agency for Health Care Administration to implement and
6
administer a Medicaid buy-in program for specified
7
working individuals with disabilities under certain
8
circumstances; providing requirements for the program;
9
requiring the agency to seek by a specified date
10
federal approval through a Medicaid waiver or state
11
plan amendment to implement the program; requiring the
12
agency to implement and administer the program upon
13
receiving federal approval; providing an effective
14
date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. This act may be cited as the "Economic Self-
19
Sufficiency for Working Individuals with Disabilities."
20
Section 2. Section 409.9141, Florida Statutes, is created
21
to read:

409.9141 Medicaid buy-in program for working individuals
23
with disabilities.—

(1)(a) Contingent upon federal approval through a Medicaid
25
waiver or a state plan amendment, the agency shall implement and
26
administer a Medicaid buy-in program, authorized under the
27
Ticket to Work and Work Incentives Improvement Act of 1999, Pub.
28
L. No. 106-170, and the Balanced Budget Act of 1997, Pub. L. No.
29
105-33, for individuals with disabilities who are between 18 and
30
64 years of age who work and whose incomes exceed the maximum
31
income eligibility level for initial enrollment to obtain
32
coverage for medical assistance under the Medicaid program. The
33
agency shall determine the new income eligibility level for such
34
individuals.

(b) The Medicaid buy-in program under paragraph (a) must
36
provide full Medicaid benefits to eligible individuals and must
37
limit any premiums or cost sharing to a percentage, as
38
determined by the agency, of an eligible individual's income.

(2) By October 1, 2026, the agency shall seek federal
40
approval through a Medicaid waiver or a state plan amendment as
41
necessary to implement the Medicaid buy-in program under this
42
section. The agency shall implement and administer the Medicaid
43
buy-in program upon receiving federal approval.

Section 3. This act shall take effect upon becoming a law.
