Use of Driver License Information for Fraud Prevention

An act relating to the use of driver license

information for fraud prevention; amending s. 322.142,

F.S.; authorizing the Department of Highway Safety and
5
Motor Vehicles to provide state agencies and certain
6
third parties with access to certain driver license
7
information for specified purposes with the licensee's
8
consent; authorizing identity verification service
9
providers to use department data under certain
10
conditions; requiring certain revenue be deposited
11
into the Highway Safety Operating Trust Fund;
12
prohibiting such providers from retaining certain
13
information; prohibiting a third party from storing or
14
selling certain information without the licensee's
15
consent; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paragraphs (c) through (n) of subsection (4) of
20
section 322.142, Florida Statutes, are redesignated as
21
paragraphs (d) through (o), respectively, a new paragraph (c) is
22
added to that subsection, and subsections (5) through (8) are
23
added to that section, to read:

322.142 Color photographic or digital imaged licenses.—
25
(4) The department may maintain a film negative or print
26
file. The department shall maintain a record of the digital
27
image and signature of the licensees, together with other data
28
required by the department for identification and retrieval.

Reproductions from the file or digital record are exempt from
30
the provisions of s. 119.07(1) and may be made and issued only:
31
(c) For the purpose of fraud prevention, identity
32
verification, or ensuring the integrity and security of
33
individual identities, with the licensee's consent, for use by:
34
1. A state agency pursuant to an interagency agreement
35
with the department.

2. A third party that has entered into a contract with the
37
department to perform identity verification services for persons
38
or entities, regulated by a state agency, pursuant to standards
39
and safeguards established by the department.

(5) An identity verification service provider may use
41
department data in a manner consistent with this section if such
42
data remains in the department's possession.

(6) Any revenue generated as a result of an agreement
44
authorized by this section shall be deposited into the Highway
45
Safety Operating Trust Fund.

(7) An identify verification service provider may not
47
retain Internet protocol addresses, geolocation data, or other
48
information that describes the location, computer, computer
49
system, or computer network from which an applicant accesses the
50
system.

(8) A third party may not store or sell images,
52
signatures, or data used pursuant to this section without the
53
licensee's consent.

Section 2. This act shall take effect July 1, 2026.
