practice dentistry and dental hygiene; amending s.

456.0145, F.S.; prohibiting specified persons from
5
being licensed through the Mobile Opportunity by
6
Interstate Licensure Endorsement Act; providing an
7
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paragraph (c) of subsection (2) of section
12
456.0145, Florida Statutes, is amended to read:
13
456.0145 Mobile Opportunity by Interstate Licensure
14
Endorsement (MOBILE) Act.—
15
(2) LICENSURE BY ENDORSEMENT.—
16
(c) A person is ineligible for a license under this
17
section if he or she:
18
1. Has a complaint, an allegation, or an investigation
19
pending before a licensing entity in another state, the District
20
of Columbia, or a possession or territory of the United States;
21
2. Has been convicted of or pled nolo contendere to,
22
regardless of adjudication, any felony or misdemeanor related to
23
the practice of a health care profession;
24
3. Has had a health care provider license revoked or
25
suspended by another state, the District of Columbia, or a
26
territory of the United States, or has voluntarily surrendered
27
any such license in lieu of having disciplinary action taken
28
against the license; or
29
4. Has not graduated from a dental college or school, or a
30
dental hygiene college or school, accredited by the American
31
Dental Association Commission on Dental Accreditation or its
32
successor entity, if any, or any other dental or dental hygiene
33
program accrediting entity recognized by the United States
34
Department of Education; or
35
5.4. Has been reported to the National Practitioner Data
36
Bank, unless the applicant has successfully appealed to have his
37
or her name removed from the data bank. If the reported adverse
38
action was a result of conduct that would not constitute a
39
violation of any law or rule in this state, the board, or the
40
department if there is no board, may:
41
a. Approve the application;
42
b. Approve the application with restrictions on the scope
43
of practice of the licensee;
44
c. Approve the application with placement of the licensee
45
on probation for a period of time and subject to such conditions
46
as the board, or the department if there is no board, may
47
specify, including, but not limited to, requiring the applicant
48
to submit to treatment, attend continuing education courses, or
49
submit to reexamination; or
50
d. Deny the application.

Section 2. This act shall take effect July 1, 2026.
