military installations located within the boundaries

of this state; providing that this state has

concurrent legislative jurisdiction with the United
10
States over those United States military
11
installations; providing procedures and requirements
12
therefor; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:
16
Section 1. Section 250.031, Florida Statutes, is created
17
to read:
18
250.031 United States military installations; concurrent
19
legislative jurisdiction.—
20
(1) This state may accept the relinquishment of exclusive
21
legislative jurisdiction from the United States in accordance
22
with this section. This state has concurrent legislative
23
jurisdiction with the United States over any United States
24
military installation property indicated pursuant to this
25
section for as long as the United States controls the property.

(2) The concurrent legislative jurisdiction over a United
27
States military installation under this section is effective
28
upon the Governor's written acceptance of a request filed with
29
the Secretary of State by the principal officer, or other
30
authorized representative who has supervision or control over
31
the military installation under 10 U.S.C. s. 2683, of the
32
military installation where concurrent legislative jurisdiction
33
is sought, relinquishing exclusive legislative jurisdiction and
34
retaining concurrent legislative jurisdiction over the military
35
installation.

(3) The Governor may not accept a request filed under
37
subsection (2) unless the request:

(a) States the name, position, and legal authority of the
39
individual requesting the cession.

(b) Unambiguously states the subject matter for the
41
concurrent legislative jurisdiction request.

(c) Describes by metes and bounds the United States
43
military installation subject to the concurrent legislative
44
jurisdiction request.

(d) Indicates whether the concurrent legislative
46
jurisdiction request includes future contiguous expansions of
47
land acquired for military purposes.

(4) If the Governor accepts a request filed under
49
subsection (2):

(a) The Governor's acceptance must state each element of
51
the concurrent legislative jurisdiction request which is
52
accepted.

(b) The Governor shall submit the following documents to
54
the appropriate recording office for indexing and submit copies
55
of the following documents to the individual who filed the
56
request for concurrent legislative jurisdiction:
57
1. The request for concurrent legislative jurisdiction.
58
2. The Governor's written acceptance of concurrent
59
legislative jurisdiction.

3. A description by metes and bounds of the United States
61
military installation subject to the concurrent legislative
62
jurisdiction.

(5) Upon request by the United States through an
64
authorized representative, the Governor is authorized to execute
65
appropriate documents to accomplish the cession granted by this
66
section.

(6) Upon establishment of concurrent legislative
68
jurisdiction under this section, a state agency, local
69
government, or special district may enter a reciprocal agreement
70
with a United States agency to designate duties related to the
71
concurrent legislative jurisdiction between the parties.

Section 2. This act shall take effect July 1, 2026.
