Automatic Dependent Surveillance Broadcasts

broadcasts; creating s. 330.42, F.S.; providing

definitions; prohibiting airports from using

information broadcast or collected by automatic

dependent surveillance broadcast systems for specified
7
purposes under certain conditions; providing an
8
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Section 330.42, Florida Statutes, is created to
13
read:

330.42 Automatic dependent surveillance broadcasts.—
15
(1) For purposes of this section, the term:
16
(a) "Aircraft" has the same meaning as in s. 330.27,
17
except that the aircraft must have a gross weight of 12,499
18
pounds or less and operate under 14 C.F.R. part 91.
19
(b) "Automatic dependent surveillance broadcast" means an
20
advanced aviation surveillance technology that combines an
21
aircraft's positioning source, aircraft avionics, and a ground
22
infrastructure to create an accurate surveillance interface
23
between an aircraft and air traffic control. The term includes
24
two different services, ADS-B In and ADS-B Out, that can provide
25
information, such as an aircraft's global positioning system
26
location, altitude, ground speed, and other data, to ground
27
stations and other aircraft, as well as weather and
28
traffic information to aircraft operators.

(c) "Touch-and-go landing" means an operation by an
30
aircraft that lands and departs on a runway without stopping or
31
exiting the runway.

(2) An airport may not use information broadcast or
33
collected by automatic dependent surveillance broadcast systems,
34
regardless of whether that data originates from ADS-B In or ADS-
35
B Out, as a means for calculating, generating, and collecting
36
fees from aircraft owners or operators who operate aircraft
37
within the geographic boundaries of this state under the
38
following circumstances:

(a) When the operation for which a fee would be assessed
40
is a departure or landing, including, but not limited to, a
41
touch-and-go landing.

(b) When the fee would be assessed based on an aircraft
43
entering into a specified radius of the airspace of the airport
44
assessing the fee.

Section 2. This act shall take effect July 1, 2026.
