An act relating to compensation for health care

services for inmates in Lake County; providing

definitions; limiting compensation to a health care

provider and to a hospital designated as a trauma
6
center that provide medical services for an inmate
7
housed in a Lake County detention center if the
8
provider and the hospital do not have a contract with
9
the county to provide such services; limiting
10
compensation to an entity that provides emergency
11
medical transportation services for an inmate housed
12
in a Lake County detention center if the entity does
13
not have a contract with the county to provide such
14
services; providing applicability; providing an
15
effective date.

Be It Enacted by the Legislature of the State of Florida:
19
Section 1. (1) As used in this act, the term:
20
(a) "Emergency medical transportation services" includes,
21
but is not limited to, services rendered by means of air
22
ambulance or an emergency medical services vehicle. As used in
23
this paragraph, the term:
24
1. "Air ambulance" means a fixed-wing or rotary-wing
25
aircraft used for, or intended to be used for, air
26
transportation of sick or injured persons requiring or likely to
27
require medical attention during transport.

2. "Emergency medical services vehicle" means a privately
29
or publicly owned vehicle or vessel that is designed,
30
constructed, reconstructed, maintained, equipped, or operated
31
for, and is used or intended to be used for, land or water
32
transportation of sick or injured persons requiring or likely to
33
require medical attention during transport.

(b) "Health care provider" means:
35
1. A hospital licensed under chapter 395, Florida
36
Statutes.

2. A physician or physician assistant licensed under
38
chapter 458, Florida Statutes.
39
3. An osteopathic physician or physician assistant
40
licensed under chapter 459, Florida Statutes.
41
4. A podiatric physician licensed under chapter 461,
42
Florida Statutes.
43
5. A health maintenance organization certificated under
44
part I of chapter 641, Florida Statutes.
45
6. An ambulatory surgical center licensed under chapter
46
395, Florida Statutes.

7. A facility the primary purpose of which is to provide
48
human medical diagnostic services or a facility providing
49
nonsurgical human medical treatment, to which facility the
50
patient is admitted and from which facility the patient is
51
discharged within the same working day, and which facility is
52
not part of a hospital. However, the term does not include a
53
facility existing for the primary purpose of performing
54
terminations of pregnancy or an office maintained by a physician
55
or dentist for the practice of medicine.

8. A professional association, partnership, corporation,
57
joint venture, or other association composed of the persons
58
described in subparagraphs 2., 3., and 4. for professional
59
activity.
60
(2)(a)1. Except as specifically provided in this
61
subsection, compensation to a health care provider to provide
62
any medical services for an inmate housed in a Lake County
63
detention center may not exceed 110 percent of the Medicare
64
allowable rate if the health care provider does not have a
65
contract with Lake County to provide inmate medical services.

2. Compensation to a health care provider to provide
67
medical services for an inmate housed in a Lake County detention
68
center may not exceed 125 percent of the Medicare allowable rate
69
if the health care provider:
70
a. Does not have a contract with Lake County to provide
71
inmate medical services; and
72
b. Reported a negative operating margin for the previous
73
year to the Agency for Health Care Administration through
74
hospital-audited financial data.

(b) Compensation to a hospital designated as a trauma
76
center by the Department of Health to provide medical services
77
for an inmate designated as a trauma alert victim, as defined
78
under Florida law, must be at 175 percent of the Medicare
79
allowable rate if the hospital does not have a contract with
80
Lake County to provide inmate medical services.

(3) Compensation to an entity to provide emergency medical
82
transportation services for an inmate housed in a Lake County
83
detention center may not exceed 110 percent of the Medicare
84
allowable rate if the entity does not have a contract with Lake
85
County to provide inmate emergency medical transportation
86
services.

(4) This act does not apply to charges for medical
88
services provided at a hospital operated by Lake County.
89
Section 2. This act shall take effect upon becoming a law.
