2 An act relating to Palm Beach County; amending chapter
3 59-1698, Laws of Florida, as amended; revising the
4 definitions of the terms "family day care home" and
5 "large family child care home" to specify the maximum
6 number of children allowed to receive care in such
7 homes in the county; providing an effective date.
9 Be It Enacted by the Legislature of the State of Florida:
11 Section 1. Section 1 of chapter 59-1698, Laws of
12 Florida, as amended, is amended to read:
13 Section 1. DEFINITIONS. The following words and phrases
14 shall mean:
15 1. Children - Persons related to the operator of a
16 facility regulated under this act under 13 years of age, and all
17 other persons under 18 years of age.
18 2. Family Day Care Home - An occupied residence in which
19 custodial care is rendered to one to six children, inclusive,
20 and for which the owner or operator receives a payment, fee, or
21 grant for any of the children receiving care, whether or not
22 operating for profit, subject to the exemptions contained in
23 Section 9. The number of children receiving care shall never
24 exceed the number of children allowed by the Florida Statutes
25 and by administrative rules of the Florida Department of
26 Children and Families.
27 3. Large Family Child Care Home - An occupied residence in
28 which custodial care is regularly provided for children, and for
29 which the owner or operator receives a payment, fee, or grant
30 for any of the children receiving care, whether or not operated
31 for profit, and which has at least two full-time child care
32 personnel on the premises during the hours of operation. One of
33 the full-time child care personnel must be the owner or occupant
34 of the residence. A large family child care home must first have
35 operated as a licensed family day care home for 2 years, with an
36 operator who has had a child development associate credential or
37 its equivalent for 1 year, before seeking licensure as a large
38 family child care home. The number of children receiving care
39 shall never exceed the number of children allowed by the Florida
40 Statutes and by administrative rules of the Florida Department
41 of Children and Families A large family child care home shall be
42 allowed to provide care for one of the following groups of
43 children, which shall include those children under 13 years of
44 age who are related to the caregiver:
45 a. A maximum of eight children from birth to 24 months of
46 age.
47 b. A maximum of 12 children with no more than four
48 children under 24 months of age.
49 4. Child Care Facility - Any building or shelter in which
50 custodial care is rendered to six or more children, and for
51 which the owner or operator receives a payment, fee, or grant
52 for any of the children receiving care, whether or not operating
53 for profit, or which is held out to the public to be an
54 establishment which regularly provides child custodial services.
55 Section 2. This act shall take effect upon becoming a law.
