An act relating to the solid waste disposal facility

in Broward County; defining the term "Monarch Hill
4
Landfill"; requiring a feasibility study and public
5
hearing before any expansion of the Monarch Hill
6
Landfill; providing requirements for the study and
7
public hearing; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Monarch Hill Landfill; Expansion Requirements
12
in Broward County.
13
(1) Definition.—As used in this section, the term "Monarch
14
Hill Landfill" refers to the solid waste disposal facility
15
located in Broward County, currently operated under permits
16
issued by the Department of Environmental Protection.
17
(2) Feasibility Study Requirement.—Before issuing or
18
approving any application, zoning change, permit, or development
19
order that would allow for the physical expansion of the Monarch
20
Hill Landfill, Broward County must commission a feasibility
21
study, to be conducted by an independent third-party entity with
22
expertise in environmental engineering, solid waste management,
23
and public health impacts. The feasibility study must include,
24
but need not be limited to:
25
(a) Assessment of the environmental and public health
26
impacts of the proposed expansion.
27
(b) Analysis of alternative waste management solutions,
28
including waste-to-energy technologies.
29
(c) Evaluation of potential impacts to surrounding
30
communities, including odor, traffic, noise, and groundwater
31
contamination.
32
(d) Consideration of the cumulative impact of existing
33
operations and the proposed expansion.

(3) Public Hearing Requirement.—At least one public
35
hearing must be held in Broward County, within a 5-mile radius
36
of the Monarch Hill Landfill, before the final approval of any
37
proposed expansion. The hearing must meet all of the following
38
requirements:
39
(a) Be publicly noticed at least 30 days in advance
40
through local media, the county's website, and direct notice to
41
property owners within a 2-mile radius of the Monarch Hill
42
Landfill.

(b) Allow for meaningful public input, including written
44
and oral testimony.
45
(c) Include a presentation of the findings of the
46
feasibility study.
47
(4) Conditions on Expansion Approval and Permitting.—
48
Approval of an application, zoning change, permit, or
49
development order that would allow for the physical expansion of
50
the Monarch Hill Landfill may not proceed until the feasibility
51
study and public hearing required in this section have been
52
completed and publicly disclosed.
53
Section 2. This act shall take effect October 1, 2026.
