3 Council, Lee County; amending chapter 2013-258, Laws
4 of Florida; revising the composition of the Lee County
5 Tourist Development Council; providing an effective
6 date.
8 Be It Enacted by the Legislature of the State of Florida:
10 Section 1. Section 1 of chapter 2013-258, Laws of Florida,
11 is amended to read:
12 Section 1. Lee County Tourist Development Council;
13 composition.—Notwithstanding the provisions of s.
14 125.0104(4)(e), Florida Statutes, the Lee County Tourist
15 Development Council as established by Lee County ordinance
16 pursuant to s. 125.0104, Florida Statutes, shall be composed of
17 eleven nine members who shall be appointed by the Board of
18 County Commissioners of Lee County. The chair of the Board of
19 County Commissioners of Lee County or another member as
20 designated by the chair shall serve on the council. Three Two
21 members of the council shall be elected municipal officials. The
22 first municipal official shall be from the most populous
23 municipality. The second municipal official, one of whom shall
24 be from one of the municipality two municipalities that
25 generated the highest revenues from the tourist tax in the most
26 recent fiscal year. If the municipality that generated the
27 highest revenues from the tourist tax in the most recent fiscal
28 year is also the most populous municipality, then the second
29 municipal official shall be from the municipality that generated
30 the second highest revenues from the tourist tax in the most
31 recent fiscal year previous 2 fiscal years and these two
32 municipalities shall rotate membership every 2 years. The third
33 second elected municipal official shall be from the other one of
34 the remaining municipalities and shall serve a term of one year
35 the second municipal seat shall also rotate every 2 years.
36 Elected municipal officials appointed to those two seats on the
37 council shall serve for terms of 2 years. Seven Six members of
38 the council shall be persons who are involved in the tourist
39 industry and have demonstrated an interest in tourist
40 development, of which members, not less than three nor more than
41 five four shall be owners or operators of motels, hotels,
42 recreational vehicle parks, or other tourist accommodations in
43 the county and subject to the tax. All members of the council
44 shall be electors of the county. The changes in the composition
45 of the membership of the Lee County Tourist Development Council
46 mandated by this act are effective July 1, 2026 2013. The
47 changes in composition of the membership of the Lee County
48 Tourist Development Council mandated by the act shall not cause
49 the interruption of the current term of any person who is a
50 member of the Lee County Tourist Development Council, except the
51 two municipal members upon the effective date of this act
52 appointed on July 1, 2013. Except as specifically provided
53 herein, the provisions of s. 125.0104(4)(e), Florida Statutes,
54 shall apply to the Lee County Tourist Development Council.
55 Section 2. This act shall take effect upon becoming a law.
