Violations of Injunctions for Protection Against Domestic Violence

An act relating to violations of injunctions for

protection against domestic violence; amending s.

741.31, F.S.; providing that a person commits a felony
5
of the third degree if such person commits a violation
6
of an injunction or foreign protection order against a
7
victim after having been convicted of any assault,
8
battery, or violation of an injunction or foreign
9
protection order against the same victim; requiring a
10
minimum term of imprisonment for such offense;
11
providing applicability; providing an effective date.

Be It Enacted by the Legislature of the State of Florida: Section 1. Paragraph (c) of subsection (4) of section

741.31, Florida Statutes, is amended to read:

741.31 Violation of an injunction for protection against
18
domestic violence.—

(4)

(c) A person who has one two or more prior convictions for
21
any assault, battery, or violation of an injunction or foreign
22
protection order, and who subsequently commits a violation of
23
any injunction or foreign protection order against the same
24
victim, commits a felony of the third degree, punishable as
25
provided in s. 775.082, s. 775.083 or s. 775.084. A person
26
convicted of violating this paragraph must be sentenced to a
27
minimum of 10 days in the county jail for each violation, unless
28
the court sentences the person to a nonsuspended period of
29
incarceration in a state correctional facility. For purposes of
30
this paragraph, the term "conviction" means a determination of
31
guilt which is the result of a plea or a trial, regardless of
32
whether adjudication is withheld or a plea of nolo contendere is
33
entered.

Section 2. This act shall take effect October 1, 2026.
